Terms of Service

Please read these terms carefully before using OnsStay. By accessing or using our platform, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and OnsStay Vacation Homes LLC ("OnsStay," "we," "us," or "our") governing your access to and use of the OnsStay platform, including our website, mobile applications, and related services (collectively, the "Platform").

By creating an account, making a booking, listing a property, or otherwise using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations.

If you do not agree to these Terms, you must not access or use the Platform.

2. Definitions

For the purposes of these Terms:

  • "Guest" means a user who books or inquires about a property through the Platform.
  • "Host" means a user who lists a property for short-term rental on the Platform.
  • "Listing" means a property advertised for rental on the Platform.
  • "Booking" means a confirmed reservation for a Listing.
  • "Service Fee" means the fees charged by OnsStay for using the Platform.
  • "Content" means text, images, videos, reviews, and other materials uploaded to the Platform.
  • "DTCM" means the Dubai Department of Tourism and Commerce Marketing.

3. Eligibility

To use OnsStay, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using the Platform under applicable laws
  • Provide accurate and complete registration information

For Hosts, additional requirements include holding valid DTCM licensing for short-term rentals and compliance with all applicable UAE regulations.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account by providing accurate, current, and complete information. You agree to update your information as necessary to maintain its accuracy.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use or security breach.

4.3 Identity Verification

We may require identity verification for certain activities, including hosting properties or making high-value bookings. You agree to provide requested documentation and consent to verification processes.

5. Guest Terms

5.1 Booking Process

When you book a property, you agree to pay the total booking amount, including the nightly rate, cleaning fees, service fees, and applicable taxes. A booking is confirmed only when you receive a confirmation from OnsStay.

5.2 Guest Responsibilities

As a Guest, you agree to:

  • Treat the property with care and respect
  • Comply with house rules set by the Host
  • Not exceed the maximum occupancy stated in the Listing
  • Report any damage or issues promptly
  • Vacate the property by the agreed check-out time
  • Not engage in illegal activities on the property

5.3 Damage and Liability

You are responsible for any damage caused to the property during your stay. OnsStay may charge your payment method for damages as assessed by the Host, subject to our dispute resolution process.

6. Host Terms

6.1 Listing Requirements

As a Host, you represent and warrant that:

  • You have the legal right to list and rent the property
  • Your property is licensed with DTCM for holiday home rentals
  • Your Listing information is accurate and not misleading
  • The property meets all safety and habitability standards
  • You will maintain appropriate insurance coverage

6.2 Host Responsibilities

Hosts agree to:

  • Provide the property as described in the Listing
  • Ensure the property is clean and ready for guests
  • Respond to guest inquiries within 24 hours
  • Honor confirmed bookings
  • Comply with all applicable laws and regulations
  • Maintain accurate calendar availability

6.3 Host Fees

OnsStay charges a Host service fee based on your selected cancellation policy tier:

7. Bookings & Payments

7.1 Payment Processing

All payments are processed through our secure payment partners. We accept major credit cards, debit cards, and select digital payment methods. Guests pay the full booking amount at the time of booking.

7.2 Service Fees

OnsStay charges a Guest service fee of 9-14% of the booking subtotal, depending on the booking value and property. This fee helps cover platform operations, customer support, and payment processing.

7.3 Currency

All prices are displayed in AED (UAE Dirhams). International transactions may incur a 2% currency conversion fee. Exchange rates are determined at the time of transaction.

7.4 Host Payouts

Hosts receive payouts within 24 hours after guest check-in, minus applicable service fees. Payouts are made via bank transfer to the account specified in your Host profile.

8. Cancellations

Cancellation terms depend on the Host's selected cancellation policy. Please refer to our Cancellation Policy for detailed information on each tier and refund eligibility.

OnsStay reserves the right to cancel bookings in cases of:

  • Suspected fraud or policy violations
  • Force majeure events
  • Safety concerns
  • Host or property compliance issues

9. User Conduct

You agree not to:

  • Violate any applicable laws or regulations
  • Post false, misleading, or fraudulent content
  • Harass, threaten, or discriminate against other users
  • Circumvent or manipulate our fee structure
  • Use the Platform for unauthorized commercial purposes
  • Scrape, copy, or extract data from the Platform
  • Interfere with the Platform's security or functionality
  • Create multiple accounts for fraudulent purposes

Violation of these conduct standards may result in account suspension or termination, and we may pursue legal remedies where appropriate.

10. Content & Intellectual Property

10.1 User Content

You retain ownership of Content you submit to the Platform. By posting Content, you grant OnsStay a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such Content for Platform operations and marketing.

10.2 Platform Content

The OnsStay name, logo, and all Platform content are protected by intellectual property laws. You may not use our trademarks or content without prior written permission.

10.3 Reviews

Reviews must be honest, accurate, and based on actual experiences. We reserve the right to remove reviews that violate our policies or contain prohibited content.

11. Limitation of Liability

11.1 Platform Role

OnsStay is a platform that facilitates connections between Hosts and Guests. We are not a party to the rental agreement between Hosts and Guests and are not responsible for the actions or omissions of users.

11.2 Disclaimer

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONSSTAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

11.3 Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONSSTAY'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ONSSTAY IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) AED 1,000.

12. Dispute Resolution

12.1 Between Users

Disputes between Hosts and Guests should first be resolved directly. If unsuccessful, either party may request OnsStay's mediation through our Resolution Center.

12.2 With OnsStay

Any disputes with OnsStay shall be resolved through binding arbitration in Dubai, UAE, in accordance with the rules of the Dubai International Arbitration Centre (DIAC). The language of arbitration shall be English.

12.3 Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict of law principles.

13. Termination

13.1 By You

You may terminate your account at any time by contacting support. Termination does not affect existing bookings or outstanding obligations.

13.2 By OnsStay

We may suspend or terminate your account for violations of these Terms, fraudulent activity, or other conduct that harms the Platform or community. We will provide notice where practicable.

13.3 Effect of Termination

Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.

14. General Provisions

14.1 Modifications

We may modify these Terms at any time. Material changes will be communicated via email or Platform notification. Continued use after changes constitutes acceptance.

14.2 Severability

If any provision is found unenforceable, the remaining provisions continue in full force and effect.

14.3 Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and OnsStay.
